NW Cedar LLC Terms and Conditions & Liability Waiver

IMPORTANT: THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY BEFORE USING NW Cedar EQUIPMENT OR SERVICES.

By booking, renting, or using NW Cedar’s sauna or cold plunge equipment or services (“Equipment”), you ("Renter" or "User") voluntarily agree to these Terms and Conditions and this Liability Waiver. You agree to use the Equipment safely, assume all risks, and waive NW Cedar’s liability to the fullest extent permitted by law.

1. Acceptance of Terms and Legal Capacity

1.1 You affirm that you are at least 18 years of age and legally competent to enter into this agreement.

1.2 These Terms apply to each instance of Equipment use, including future rentals and visits.

2. Equipment Use and Safety

2.1 You are renting Equipment for personal use and agree to use it responsibly and in accordance with all provided instructions, safety guidelines, and applicable laws.

2.2 NW Cedar requires an 8' x 12' flat, accessible area for Equipment setup. If the location is deemed unsafe or inaccessible upon delivery, you will be responsible for 50% of the rental fee.

2.3 You agree to supervise all users of the Equipment and ensure their compliance with these Terms.

3. Assumption of Risk

3.1 You understand and acknowledge that the Equipment, as well as sauna and cold plunge use carry inherent risks, including but not limited to: burns, heat stroke, hypothermia, slips, falls, illness (including COVID-19), physical strain, allergic reactions, heart complications, death or property loss.

3.2 These risks apply both inside and outside of the Equipment and include use of related areas (e.g., showers, stairs, seating, sidewalks, parking, changing spaces, etc.). Using the equipment places extreme stress on a person’s body, and you assume these risks.

3.3 You certify that you are physically fit and healthy enough to use the Equipment, and to participate in sauna and cold plunges, and that you have not been advised otherwise by a qualified medical person.

YOU ACKNOWLEDGE THAT USE OF THE EQUIPMENT IS OPTIONAL AND THAT YOU HAVE THE CHOICE NOT TO USE THE EQUIPMENT, AND YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ALL RISKS AND DANGERS ASSOCIATED WITH YOUR USE OF THE EQUIPMENT.

4. Waiver,Release of Liability, and Indemnification.

In consideration of permitting you to use the Equipment and to participate in sauna and cold plunge related activities, as well as all activities related to or connected with the Equipment and NW Cedar LLC, you hereby choose and act for yourself, your executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) Waive, Release and Discharge NW Cedar LLC, its directors, officers, employees, volunteers, agents, attorneys, insurers, affiliates (collectively “Releasees”), from any and all liability for your death, disability, personal injury, illness, property damage, property theft, lost income, or any other losses, costs or actions of any kind which hereafter may accrue to you by virtue of use of the Equipment, or any other conduct related to the Equipment; (B) Indemnify and Hold Harmless Releasees from any and all liabilities or claims made by other individuals or entities as a result of any of your actions related to the Equipment or your rental of the Equipment, including injuries or harm to others who use the Equipment while in your care or on your property; (C) Covenant not to sue Releasees and agree that you will not make any claim against Releasees for injury, illness, damages, death, or any other loss arising from or related to you use of the Equipment. You understand that if you attempt to sue Releasees in violation of this agreement, Releasees may seek to recover all of their costs, including legal fees. You agree to indemnify, hold harmless, and defend Releasees from and against any and all actions, causes of action, claims, charges, demands, losses, damages, costs, attorney’s fees, judgments, liens, indebtedness and liabilities of every kind and character, whether known or unknown, including foreseen or unforeseen bodily injury, illness, and personal injuries and property damage that may be sustained by you or any other person in any way connected to, related to, or arising out of your use of the Equipment.

6. Recommended Sauna and Cold Plunge Use Guidelines

Before Sauna Use:

Hydrate thoroughly with water.
Shower to cleanse skin.
Remove metal jewelry.
Wear a swimsuit or towel (consider a sauna hat for heat sensitivity).

During Sauna Use:

Limit sessions to 10–15 minutes for beginners; max 20 minutes for experienced users.
Stay hydrated throughout.
Do not consume alcohol.
Exit immediately if feeling unwell.
Do not exercise in the sauna.
Be respectful of shared spaces.

After Sauna Use:

Cool down with a shower or cold plunge.
Rehydrate with 2–4 glasses of water.
Rest and recover before repeating or ending the session.

Important Sauna Safety Tips:

Children must be supervised and limited to 15-minute sessions.
Consult your doctor before use if you are pregnant, have low blood pressure, heart issues, or other medical conditions.
Follow the "200 Rule" (temperature °F + minutes = max 200).

Cold Plunge Guidelines:

Start with 30 seconds to 1 minute; increase to 2–5 minutes as tolerated.
Ideal water temp: 50–60°F (never below 40°F).
Never plunge alone; have someone present.
Breathe calmly and exit if lightheaded or uncomfortable.
Hydrate before and after.
Do not use alcohol or other substances.
Consult your physician if you have any medical conditions.

NW Cedar LLC does not give medical advice. By using the Equipment you have determined, either independently or through consultation with experts, that it is safe for you to use.

7. Booking, Payment, and Cancellation

7.1 50% payment is required to confirm a booking. Remaining 50% will be charged 24 hours prior to the rental date.

7.2 Cancellation and refund terms are available on the NW Cedar website or booking page.

7.3 Fees are non-refundable for unsafe or inaccessible delivery sites as described in Section 2.2.

8. Compliance and Conduct

8.1 You agree to follow all NW Cedar policies, safety instructions, and reasonable requests.

8.2 NW Cedar reserves the right to cancel, modify, or refuse service if terms are violated or if the site or use is deemed unsafe.

9. Intellectual Property

All NW Cedar content, logos, guides, and media are protected intellectual property. You may not reproduce or distribute these materials without written permission.

10. Changes to Terms

These Terms may be updated at any time. Continued use of Equipment or services constitutes acceptance of updated Terms.

11. Legal Venue, Governing Law, and Dispute Resolution

11.1 These Terms are governed by the laws of the State of Oregon.

11.2 Any dispute or claim that arises out of or that relates to the Equipment, this agreement, or to the interpretation or breach thereof, or to the existence, validity, or scope of this agreement or the arbitration agreement, shall be resolved by arbitration in accordance with the then effective arbitration rules of (and by filing a claim with) Arbitration Service of Portland, Inc., and judgment upon the award rendered pursuant to such arbitration may be entered in any court having jurisdiction thereof.

11.3 In any dispute, the prevailing party is entitled to recover reasonable attorney’s fees and costs.

11.4 If any portion of this agreement is found unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

12. Entire Agreement and Acknowledgment

This document constitutes the entire agreement between you and NW Cedar. No oral statements, marketing, or prior communications modify these Terms unless agreed in writing. This Agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. You understand that you are giving up substantial rights, including my right to sue Releasees for injuries resulting from the inherent risks of using the Equipment and from sauna and cold plunges, and the ordinary negligence of Releasees.

BY RENTING OR USING NW Cedar EQUIPMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS ENTIRE AGREEMENT, INCLUDING ALL RISK WARNINGS, AND FREELY AGREE TO BE LEGALLY BOUND BY IT.
